This Site and all of the content made available on it, including but not limited to, all merchandise, designs, images, illustrations, photographs, graphics, text and all other copyrightable material, all trademarks, trade names, service marks, logos and domain names, and all other forms of intellectual property (“Content”), are owned by Cate & Levi or third parties, and are protected from unauthorized use, copying and dissemination by copyright, trademark, publicity and other laws and international treaties.  

Cate & Levi grants to you a non-exclusive, limited purpose license to access and view this Site, and to print selected pages that appear on this Site for your own personal reference and non-commercial use, but not to otherwise use the Content in any manner not expressly authorized in these Terms and Conditions.  Nothing contained in these Terms and Conditions may be interpreted to grant to you any other license or right to access or use any of the Content without the prior written consent of Cate & Levi or any third party owner of the Content.  UNAUTHORIZED USE, COPYING, REPRODUCTION, MODIFICATION, REPUBLISHING, UPLOADING, DOWNLOADING, POSTING, TRANSMITTING, DISTRIBUTING OR DUPLICATING, OR ANY OTHER MISUSE, OF ANY OF THE CONTENT IS STRICTLY PROHIBITED.  As a user of this Site, you agree not to use the Content for any unlawful purpose, and not to violate Cate&Levi's rights, or any third party owner’s rights, in and to the Content.

If you provide your e-mail address to Cate&Levi when purchasing from this Site, you will occasionally receive information from us relating to new products, sales and other Cate&Levi news that may be of interest to you. You may request at any time to be taken off the email list by simply opting out through one of our emails.

By placing an order, you are representing and warranting that you are over 18 years of age, that you are providing Cate & Levi with accurate, truthful and complete information, and that you have the authority to place the order.

Please review Cate & Levi’s Shipping and Return Policies before placing orders on our Site or otherwise. We will not be liable for any loss, damage, cost or expense related to delays in shipment or delivery of merchandise. The risk of loss, and title to, all merchandise purchased on this Site or otherwise will pass to you upon our delivery of that merchandise to the carrier selected to deliver it.

5% GST (Goods and Service Tax) will be added to all products shipped to destinations within Canada. An additional 8% PST (Provincial Sales Tax) will be added to all products shipped to destinations within the province of Ontario.

No Canadian tax is added to products shipped to destinations outside of Canada. These products may, however, be subject to import duties or taxes in accordance with the laws of the destination country, which you or the recipient will be responsible for at the time of delivery. For more information regarding your country’s custom policies, please contact your local custom office.

For your convenience, Cate & Levi may include links to other websites over which Cate & Levi has no control. Cate & Levi provides no endorsement or representation of any kind regarding the products, services, content or appropriateness of content of such websites, and you hereby irrevocably waive any claim against Cate&Levi with respect to such websites. You should carefully review the terms and conditions of use associated with these websites before making use of them.

You agree to indemnify and hold harmless Cate & Levi, and its directors, officers, employees, contractors and suppliers, from and against any and all claims, demands, actions, proceedings and damages, including without limitation reasonable attorneys’ fees and costs, arising from or related to your use of this Site.

This Site is controlled by Cate&Levi within the Province of Ontario, Canada. This Site can be accessed from all provinces and territories of Canada, as well as from other countries around the world. As each of these jurisdictions has laws that may differ from those of the Province of Ontario, by accessing this website, you agree that any dispute arising between us shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its principles of conflicts of laws. You also agree and hereby submit to the exclusive personal jurisdiction and venue of the courts of the Province of Ontario and acknowledge that you do so voluntarily and are responsible for complying with local laws. You waive any claim or defense of inconvenient forum or lack of personal jurisdiction.

Cate & Levi reserves the right to change or modify all or any portion of this Site, including any and all Content, merchandise or services featured on this Site, at any time in our sole discretion. Prices are subject to change without notice, and if any prices are incorrectly listed, we reserve the right to refuse, cancel or limit any orders placed for merchandise or services at the incorrect price.

Cate & Levi reserves the right to update or modify these Terms and Conditions at any time without prior notice. We will not be obligated to notify you of these changes as and when they are made. Your use of this Site following any such change constitutes your agreement to follow and be bound by the Terms and Conditions as updated, modified or changed. For this reason, we encourage you to review these Terms and Conditions whenever you use this Site.
